Europe’s Highest Court Confirms OSHO Trademark/Lovemark!
The European General Court – a branch of Court of Justice of the European Union – Makes Final Decision on OSHO Trademark and confirms ownership by Osho International Foundation

A decision by the EU General Court in Luxembourg from October 11, 2017 is now final and confirms the validity of the OSHO trademark and ownership by Osho International Foundation, Switzerland [case T670/15].

In this article we will look at the legal case findings, its implications, and provide background about the necessity of protecting Osho’s name, original work, and the OSHO trademark.

The final decision confirms two previous decisions by the European Union Intellectual Property Office (EUIPO) in 2014 and 2015, which clarified the decision in favor of OIF’s claim to the mark, rejecting any attempt to cancel it.

The attempt to invalidate the OSHO trademark has been part of a concerted attack by a small group of people, attempting to gain control of Osho intellectual property. These people were previously involved in the foundation’s work, including and spearheaded by Robert Doetsch, also known as Swami Ramateertha, the controlling figure of a local Osho Meditation Center in Cologne Germany. Doetsch who is also a disciple of UG Krishnamurti used an Osho Mediation Center to launch a legal attack on Osho’s work.

Doetsch was and is involved in other similar attacks, including a 2014 attempt to take control of the Swiss foundation.

In an unusually worded stinging response, the Swiss government rejected all claims made against the directors of the foundation and confirmed that Doetsch had mislead the Swiss Authorities with false and malicious accusations. Additionally, the Swiss found that he had intentionally withheld the fact that since 2000, Doetsch and other parties attempted to take legal action against Osho International Foundation (OIF) in various countries, with the aim of “bringing down” the trademarks and copyrights of OIF. Doetsch and his group had taken steps to highjack the foundation, a foundation from which Osho had personally requested Doetsch to resign thirty years earlier in 1986 after he was initially appointed to the board by Sheela Silverman.

As was the case in the Swiss action, Doetsch intentionally mislead the European Trademark Office, pretending to be an independent party, hiding his previous close relationship with the foundation. On this point the judges stated, “The Applicant [Osho Lotus Commune e.V and Robert Doetsch] has attempted to conceal its long standing association with OIF.”

In the context of these legal cases, Doetsch and his group, acting like politicians, for years published “fake news,” intentionally spreading misinformation about trademarks and their use in the context of Osho’s work, misleading the public in order to damage the integrity and reputation of the foundation created by Osho to carry on his work. Both the Swiss Government and the EU Trademark Office exposed these details as, “malicious,” “false,” “deliberately confusing,” and “unsubstantiated.” In spite of these clear decisions from these government bodies Doetsch and his group continued their endeavor to cause divisions between people involved in Osho’s work.

Ramateertha misled people and Osho centers with false details about OSHO trademarks, financial misinformation and so on, basically trying to paint Osho’s foundation as basically criminal, commercial, and controlling.

After instructing that his entire work be known and presented under “OSHO,” in January 1990 Osho reviews the re-branding of his work – the program presentations of the OSHO Multiversity.

What Is the OSHO Trademark? The “OSHO” Trademark is also considered a “Lovemark.”  A Lovemark is a marketing concept intended to associate aspects of the brand not captured under trademark that includes the emotional connection people have with a brand or public figure.

People come in contact with OSHO in various ways, including Osho’s books and publications, meditations, music and talks via OSHOPlay.  Many people also a visit to the OSHO International Meditation Resort and take courses through OSHO Multiversity. The beauty of Osho’s work is that people can experience it in many forms anywhere in the world.

Trademarks are “source-indicators.” They confirm the place in which a product or service is delivered. Trademarks are used for commercial profit and not-for-profit purposes to convey and protect the owned likeness of a brand from misuse.  The reason why OSHO may also be associated as a Lovemark is that Osho describes the connection to him and his work as a “love affair.”

In his accusation that the OSHO trademark is “monopolization,” Doetsch showed a total misunderstanding of trademarks, of the protection of intellectual property and personality rights, and intentionally misinterpreted Osho and his request to protect his name and work and stated in these proceedings: “The intentions of Osho himself are irrelevant.”  The court rejected all such arguments and confirmed what Osho wanted all along: that his work be made available, under the mark OSHO, which can be disseminated under the quality control of the Foundation by people Osho trusted.

The OSHO trademark is available free of charge under license for Osho’s meditation centers and entities who share Osho’s vision in connection with the foundation.

The mark is not available to people who try to run an unauthorized personal businesses for their enrichment, nor for activities, as in Doetsch’s and his group case, explicitly against Osho’s foundation.

A very important aspect in this case was Doetsch trying to misrepresent Osho by putting him in the same category as Jesus and Buddha and other religious leading figures who are today exploited by the established religions. The court rejected any such comparison and any argument in this direction. Osho is an individual of modern times, enjoying legal protection of his work, his copyrights and his name – even if some people do not understand the point Osho makes throughout his public life, fighting these very religious figures and the religions they brought about.

Osho has been endlessly clear that, no matter how much we may want him to be some charismatic savior figure, he is not a “leader” of any sort, religious or otherwise, and in particular he emphatically distanced himself from all such historical figures:

So I have been carrying a heavy weight on me, on my heart. My health has been destroyed for many reasons; the most important is that I have been speaking on people with whom I do not agree at all. I disagree – not only disagree, but I find them basically psychotic, neurotic, schizophrenic, anti-life. All these religions in the past are anti-life. Nobody is for life, nobody is for living, nobody is for laughter. No religion has accepted a sense of humor as a quality of religiousness.”

In 1989, Osho requests that the presentation of his complete work in all aspects, including his meditations and meditation centers be re-branded under “OSHO,” replacing the long-standing brand of his previous name. Osho requests that all products and services are branded with “OSHO.”

The court acknowledged and confirmed that activities, services and products in word-combinations like ‘Osho Meditations’, ‘Osho Meditation Centers, ‘OSHO TIMES’, ‘“OSHO” as author’, ‘Music from the World of Osho’, ‘Osho Dance Meditation Training’; ‘Osho Full Moon Camp’; ‘Osho Management Training’; ‘Osho Festival’, ‘Osho Celebrations’, ‘Osho Pulsation Training’ and so on, are covered by legal trademark protection, “since the [Foundation] operates under the name of OSHO, explicitly aims at promoting the lifework and visions of OSHO and consequently brands all its activities under this mark.”

Statements from numerous meditation teachers and so-called Osho therapists, submitted in support of the brand’s invalidation, were decisively rejected by the judges who pointed out that these statements seemed to be related to their personal income and in direct relation to Osho Lotus.
Since the verdict, several people have publicly apologized for their participation and support in attacking Osho’s and the Foundation’s work.

It is now finally decided by the court that the OSHO trademark is not in the public domain and cannot be used by everybody for publication, promotion, advertisement, or any meditation activity, social media accounts, groups, or activities, unless permitted. The judgment makes it clear that just feeling “inspired” by Osho is not an acceptable argument to use the mark in any way. “Unlike ‘Buddha,’ OSHO is not a name that belongs firmly in the public domain,” which clarifies that in the online social media world, accounts, and websites which use the mark or author name, Osho, and publish or offer infringing and/or unrelated services or products under the mark, “OSHO” are infringements of the valid mark of the foundation.

The mark is valid in more than 40 countries. With this decision the European Court has defended the trademark “OSHO” from an attempt to remove the protection of Osho’s work – a protection by trademark law which has been in place since the 1970’s.

Osho International Foundation holds, protects, and actively licenses the copyrights of Osho’s works and the brand name OSHO and has done so since 1985 and 1989 respectively. Both protective legal concepts of copyright and trademark were already legally implemented during Osho’s lifetime and have always been the legal framework of his work. Any claims that Osho’s work and intellectual properties should be without legal protection or claims that he personally wanted his work to be unprotected and freely available indiscriminately to everyone is nonsense, malicious, and an attempt to undermine his work as he left it. Based on this decision, the foundation is now able to take all necessary steps to protect these rights and to present Osho’s work as he envisions.

Europas Höchstes Gericht Bestätigt OSHO Trademark / Lovemark!

Das Gericht der Europäischen Union – Teil des Europäischen Gerichtshofes (EuGH), mit Sitz in Luxemburg – das oberste rechtsprechende Organ der Europäischen Union (EU) – trifft eine endgültige Entscheidung über die OSHO Trademark und bestätigt Osho International Foundation als Eigentümerin der Marke.

Ein Urteil des Gerichts der Europäischen Union in Luxemburg vom 11. Oktober 2017 ist nun rechtskräftig und bestätigt die Gültigkeit der OSHO Trademark als Eigentum der OSHO International Foundation, Schweiz [Fall T670 / 15].

In diesem Artikel werden wir die Vorgeschichte dieses Rechtsfalls und dessen Auswirkungen näher betrachten und den Lesern der OSHO Times einen Hintergrund geben, warum Osho die Notwendigkeit sieht, seinen Namen und seine Arbeit rechtlich zu schützen, und warum die OSHO Trademark so einzigartig und erfolgreich ist.

Die letztendliche Entscheidung in diesem Fall ist in der Tat die rechtliche Bestätigung zweier früherer Entscheidungen des Amt der Europäischen Union für geistiges Eigentum (EUIPO) in den Jahren 2014 und 2015, die zwei sehr klare Entscheidungen zugunsten des Anspruchs der OIF auf die Marke getroffen und jeden Versuch abgelehnt hatte, die Marke zu löschen. Das Gericht hat in diesem abschließenden Urteil die früheren Entscheidungen des EUIPO zu jedem einzelnen Punkt bestätigt. Die OSHO Times hatte bereits über die Entscheidung des EUIPO berichtet.

Der Versuch, die OSHO Schutzmarke für ungültig zu erklären, war Teil eines gemeinsamen Angriffs einer kleinen Gruppe von Personen, die versuchte, das geistige Eigentum von Osho unter ihre Kontrolle zu bringen. Diese Personen waren zuvor in die Arbeit der Foundation involviert, unter anderem Robert Doetsch, der auch als Swami Ramateertha, die dominierende Führerfigur eines lokalen Osho Meditationszentrums in Köln, bekannt ist. Doetsch, ebenfalls ein Anhänger von UG Krishnamurti, benutzte ein Meditationszentrum für einen juristischen Angriff auf Oshos Arbeit.

Doetsch war und ist an anderen ähnlichen Angriffen beteiligt, darunter an einem Versuch im Jahr 2014, die Kontrolle über die Schweizer Stiftung zu übernehmen. In einer ungewöhnlich scharf formulierten Antwort wies die Schweizer Regierung alle Anschuldigungen gegen die Direktoren der Stiftung zurück und bestätigte, dass Doetsch die Schweizer Behörden mit falschen und bösartigen Anschuldigungen getäuscht hatte. Zudem bestätigten die Schweizer Behörden, dass er vorsätzlich Informationen zurückgehalten hatte, dass er und ihm nahestehende Personen seit dem Jahr 2000 versucht hatten, gegen die International Foundation (OIF) in verschiedenen Ländern rechtliche Schritte einzuleiten, um die Schutzmarken und Urheberrechte der OIF „zu Fall zu bringen“. Doetsch und seine Gruppe hatten Schritte unternommen, um Kontrolle über die Stiftung zu bekommen, eine Stiftung, aus der Osho Doetsch dreißig Jahre zuvor, im Jahr 1986, persönlich gebeten hatte zurückzutreten, nachdem er von Sheela Silverman zunächst in den Vorstand berufen worden war.

Wie bei der Schweizer Aktion führte Doetsch das Europäische Markenamt vorsätzlich in die Irre, indem er vorgab, eine unabhängige Partei zu sein und seine frühere enge Beziehung zur Stiftung verheimlichte. Zu diesem Punkt erklärten die Richter: „Der Beschwerdeführer [Osho Lotus Commune e.V. und Robert Doetsch] hat versucht, seine langjährige Verbindung mit der OIF zu verheimlichen.”

Im Rahmen dieser Rechtsfälle veröffentlichten Doetsch und seine Gruppe, die wie Politiker handeln, jahrelang „Fake News”, verbreiteten absichtlich Falschinformationen über Trademarks und ihre Verwendung im Zusammenhang mit Oshos Werk, führten die Öffentlichkeit in die Irre, um die Integrität und den Ruf der Stiftung zu schädigen, die von Osho geschaffen wurde, um seine Arbeit fortzusetzen. Sowohl die Schweizer Regierung als auch das EU-Markenamt enthüllten diese Details als „bösartig”, „falsch”, „absichtlich verwirrend” und „unbegründet”. Trotz der klaren Entscheidungen dieser Regierungsorgane setzten Doetsch und seine Gruppe ihre Bemühungen fort, Spaltungen zwischen den an Oshos Werk beteiligten Personen zu verursachen.

Ramateertha führte Leute und Osho Zentren mit falschen Details über OSHO Trademarks, finanziellen Falschinformationen usw. in die Irre und versuchte im Prinzip, Oshos Stiftung als kriminell, kommerziell und kontrollierend darzustellen.

Im Januar 1990 besichtigt Osho die umbenannten Programmpräsentationen der OSHO Multiversity, nach seiner Anweisung, seine Arbeit und Werk als „OSHO” zu präsentieren.

Wofür ist die OSHO Marke – und wofür nicht?

„OSHO” hat sich nun zu einer „Lovemark” entwickelt, zu einer dieser ungewöhnlichen Situationen, in denen eine Schutzmarke weit mehr ist als ein kommerzieller Quellenindikator – sie entwickelte zusätzliche Aspekte einschließlich einer emotionalen Assoziation, Respekt und Liebe.

Menschen kommen auf vielen verschiedenen Ebenen mit OSHO in Kontakt, durch Publikationen von Werken Oshos und der Stiftung, durch Meditationserfahrungen, „Musik aus der Welt von Osho“, Videos im Internet, Hörbücher, einen Besuch im OSHO International Meditation Resort oder in einem OSHO Meditation Center … und durch viele andere Möglichkeiten. Es gibt so viele individuelle Erfahrungen, wie es Individuen gibt.

Osho hat ein unglaubliches Verständnis dafür, sein Werk zu präsentieren und erkennbar zu machen (to brand) indem er zu allem seinen Namen hinzufügt, zu Gebäuden, zu Meditationen, zu Musik, zu Abteilungen, zu Diskotheken – eigentlich zu allem, was ursprünglich mit seinem Werk zu tun hatte und unter dem Namen „Rajneesh”[1] geschützt war. Schon in den siebziger Jahren war sein Name ein international eingetragenes Warenzeichen, das sein Werk schützte und diesen Namen seiner Foundation und seinen Meditationzentren vorbehielt. Osho stellte so sicher, dass sein Name und seine Marke auf der ganzen Welt bekannt waren.

Schutzmarken sind „Herkunfts-Kennzeichen” – sie bestätigen, woher ein Produkt oder eine Dienstleistung kommt. Wir kennen Markennamen hauptsächlich in einem kommerziellen und korporativen Kontext und sind vertraut mit großen Markennamen wie SONY®, Microsoft® und Apple®, aber das Markenrecht gewährt auch gemeinnützigen Organisationen mit nichtkommerzieller Ausrichtung den gleichen Schutz und, wie in Oshos Fall, einem „spirituellen” oder mehr „philosophischen” Aspekt und Schwerpunkt ihrer Dienstleistungen, Arbeit und Produkte. Osho beschreibt die Verbindung zu ihm und seiner Arbeit oft als „Liebesaffäre”.

Zu seinen Lebzeiten schuf Osho eine Stiftung, die für die offizielle Verbreitung und Veröffentlichung seiner Arbeit, des Markennamens und der Trademark verantwortlich ist, die die Stiftung als formale Quelle angibt. Publikationen, Namen für Meditationszentren und Meditationen kommen von der Stiftung und werden gemeinsam von Personen genutzt, die sich involvieren und verbunden fühlen, basierend auf Oshos Anregung von „Mitarbeit“‚ „Kontribution“, „Meditation“ und „Festlichkeit“. Die OSHO Trademark, heute für viele eine „Lovemark”, repräsentiert eine breite Palette an digitalen Produkten, Büchern, Meditationsangeboten, sowie ein ganzes „Lifestyle Programm“, das viele Aspekte seiner Vision unter einer „Lovemark” vereint.

In seinem Vorwurf, die OSHO Marke sei eine „Monopolisierung”, zeigt Doetsch ein völliges Missverständnis von Schutzmarken, des Schutzes von Urheberrechten und von Persönlichkeitsrechten, und er interpretiert absichtlich Osho und seinen Wunsch, seinen Namen und sein Werk zu schützen, falsch und erklärt in diesem Verfahren: „Die Absichten von Osho selbst sind irrelevant.” Das Gericht wies alle diese Argumente zurück und bestätigte Oshos Intention: Dass sein Werk unter der Marke OSHO verbreitet wird, unter der Qualitätskontrolle der Foundation, von Menschen, denen Osho vertraut. Und dass er verhindern wollte, dass jeder „Hinz und Kunz” unter einer OSHO-Assoziation operieren kann und vorgibt, in einer „Osho-Nachfolge” zu stehen, indem er seine eigenen Ideen oder verzerrten Versionen von Oshos Vision anbietet.

Die OSHO Schutzmarke ist für Osho Meditationszentren und Institutionen, die Oshos Vision in Verbindung mit der Stiftung unter Lizenz anbieten, kostenlos verfügbar. Die Marke steht für nicht autorisierte persönliche Geschäfte und persönliche Bereicherung nicht zur Verfügung, auch nicht für Aktivitäten, wie im Falle von Doetsch und seiner Gruppe, die explizit gegen die Osho Foundation gerichtet sind.

Ein sehr wichtiger Aspekt in diesem Fall war die Fehlinterpretation von Osho durch Doetsch, indem er ihn in die gleiche Kategorie wie Jesus und Buddha und andere religiöse Führerfiguren einordnete, die heute von den etablierten Religionen ausgebeutet werden. Das Gericht wies einen solchen Vergleich und jedes Argument in dieser Richtung zurück. Osho ist ein Individuum der Neuzeit, er genießt Rechtsschutz seiner Arbeit, seiner Urheberrechte und seines Namens – auch wenn einige Leute den Standpunkt nicht verstehen, den Osho während seines öffentlichen Lebens vertrat, als er genau diese religiösen Figuren und die Religionen, die sie hervorgebracht haben, bekämpfte.

Osho hat immer wieder klargestellt, dass er, egal wie sehr wir ihn als charismatische Erlöserfigur sehen wollen, kein „Führer” irgendeiner Art ist, weder in einem religiösen noch in irgendeinem anderen Sinne, und er distanzierte sich ausdrücklich von all diesen historischen

Figuren:

„Ich habe ein schweres Gewicht auf mir, auf meinem Herzen getragen. Meine Gesundheit wurde aus vielen Gründen zerstört. Wichtig ist, dass ich über Menschen gesprochen habe, mit denen ich überhaupt nichts gemein habe. Ich lehne sie nicht nur ab, sondern ich sehe sie im Grunde als psychotisch, neurotisch, schizophren und lebensverneinend an. All diese Religionen in der Vergangenheit sind lebensverneinend. Niemand ist fürs Leben, niemand ist für Lebendigkeit, niemand ist fürs Lachen. Keine Religion hat Humor als ein Element von Religiosität akzeptiert.” ~ Osho

Das Gericht erkannte und bestätigte, dass Aktivitäten, Dienstleistungen und Produkte in    Wortkombinationen wie „Osho Meditationen”, „Osho Meditationszentren”, „OSHO TIMES”, „OSHO” als Autorenname”, „Musik aus der Welt von Osho”, „Osho Tanz-Meditationstraining”; „Osho Vollmond Camp”, „Osho Management Training”, „Osho Festival”, „Osho Celebrations”, „Osho Pulsation Training” und so weiter durch juristischen Markenschutz geschützt sind, „da die [Stiftung] unter dem Namen OSHO operiert, zielt sie explizit auf die Verbreitung des Lebenswerks und der Visionen von Osho ab und präsentiert konsequent alle seine Aktivitäten unter dieser Marke.”

Die Tatsache, dass Osho die Aufgabe, dieses geistige Eigentum zu schützen und zu veröffentlichen, einer Stiftung übertragen hat, es unter den Schutz einer spezifischen Gruppe von Personen stellte, wurde von Doetsch als „Monopolisierung” angegriffen – eine Interpretation, die von den Richtern völlig abgewiesen wurde.

Erklärungen von zahlreichen Meditationslehrern und sogenannten Osho Therapeuten, eingereicht zur Unterstützung der Ungültigkeitserklärung der Marke, wurden von den Richtern entschieden zurückgewiesen, unter dem Hinweis, dass diese Stellungnahmen mit ihren persönlichen Einnahmen in Verbindung zu stehen schienen. Seit dem Urteil haben sich mehrere Personen öffentlich für ihre Beteiligung und Unterstützung am Angriff auf Oshos und der Foundation Arbeit entschuldigt. Aneesha, Kovida

Es ist nun endgültig durch das Gericht entschieden, dass die OSHO Schutzmarke kein Allgemeingut ist und nicht von jedermann für Publikationen, Werbung, Annoncen, diverse Meditationsaktivitäten, Nutzerkonten in sozialen Medien, Gruppen oder Aktivitäten verwendet werden kann, es sei denn, dies ist genehmigt. Das Urteil macht deutlich, dass ein bloßes Gefühl, von Osho „inspiriert” zu sein, kein akzeptables Argument für die Verwendung des Markennamens in irgendeiner Weise ist. „Im Gegensatz zu dem Namen ‘Buddha’ ist Osho kein Name, der fest in der Öffentlichen Domäne verankert ist.“ Dies stellt klar, dass in der Online Welt der sozialen Medien und Webseiten die unberechtigte Benutzung der Marke oder des Autorennamens Osho für Publikationen und/oder beziehungslose Dienstleistungen oder Produkte unter dem Markennamen OSHO Rechtsverstöße gegen die gültige Marke der Stiftung sind.

Die OSHO Schutzmarke, unter der die Foundation und qualifizierte Lizenznehmer operieren und Dienstleistungen und Produkte anbieten, ist in mehreren relevanten Markenklassen registriert. Siehe: EU „OSHO” Marke 01245300.

Die Marke ist in mehr als 40 Ländern gültig. Mit dieser Entscheidung hat der Europäische Gerichtshof die Marke „OSHO” vor einem Versuch verteidigt, den Rechtsschutz von Oshos Werk zu entfernen – ein Schutz durch Markenrecht, der seit den 70er Jahren existiert.

Die Osho International Foundation besitzt, schützt und lizensiert aktiv die Urheberrechte von Oshos Werken und den Markennamen OSHO und hat dies seit 1985 resp. 1989 getan. Beide geschützten rechtlichen Konzepte von Urheberrechten und Schutzmarken wurden bereits zu Lebzeiten Oshos legal umgesetzt und waren schon immer der rechtliche Rahmen seiner Arbeit. Alle Behauptungen, dass Oshos Werk und sein geistiges Eigentum ohne rechtlichen Schutz sein sollen, oder Behauptungen, dass er persönlich seine Arbeit ungeschützt und für jedermann wahllos frei verfügbar haben wollte, ist Unsinn, böswillig, und ein Versuch, sein Werk, so wie er es hinterlassen hat, zu schädigen. Aufgrund dieser Entscheidung ist die Stiftung nun in der Lage, alle notwendigen Schritte zu unternehmen, um diese Rechte zu schützen und Oshos Werk nach seinen Vorstellungen zu präsentieren.

Решение Генерального суда ЕС в Люксембурге от 11 Октября 2017 года является окончательным и подтверждает действительность товарного знака OSHO и права собственности Osho International Foundation, Швейцария [дело T670 / 15].

В этой статье мы внимательно рассмотрим предысторию этого судебного дела, а также его последствия, и дадим читателям Osho Times понимание, почему Osho видел необходимость в юридической защите своего имени и своей работы, и почему товарный знак OSHO настолько уникален и успешен.

Попытка аннулировать товарный знак OSHO была частью согласованного нападения небольшой группы людей, пытающихся получить контроль над интеллектуальной собственностью Osho. Эти люди ранее участвовали в работе фонда, ими руководил Роберт Деч, также известный как Свами Раматирта, контролирующий работу местного центра медитаций Ошо в Кельне, Германия. Как и в случае со швейцарской акцией, Деч намеренно ввел в заблуждение Европейское Ведомство по товарным знакам, притворившись независимой стороной, скрыв свои предыдущие тесные отношения с фондом. По этому вопросу судьи заявили: “заявитель [Osho Lotus Commune e.V и Роберт Деч] попытался скрыть свою давнюю связь с OIF”.

В контексте этих судебных дел Деч и его группа, действуя как политики, в течение многих лет публиковали “поддельные новости”, намеренно распространяя дезинформацию о товарных знаках и их использовании в контексте работы Osho, вводя в заблуждение общественность, чтобы нанести ущерб репутации фонда, созданного Osho для продолжения его работы. Ошо после проведения беседы о том, что вся его работа отныне будет известна и представлена как “OSHO”, в январе 1990, рассматривает ребрендинг своей работы – программные презентации Osho Multiversity.

Для чего нужен товарный знак OSHO – и для чего он не подходит?

“OSHO” получил развитие и превратился в “Lovemark” («знак любви») – это одна из абсолютно уникальных ситуаций, когда бренд и торговая марка выходят за рамки коммерции и развивают дополнительные аспекты, включая эмоциональную связь, уважение и любовь.

Люди входят в контакт с OSHO на самых разных уровнях: публикуя работы Osho и Фонда, знакомясь с опытом медитаций, слушая музыку из мира Osho, просматривая видео в интернете, слушая аудиокниги, посещая Международный Медитационный курорт Osho или центры медитаций Osho, и разными другими путями. Существует столько же различных вариантов, сколько в мире индивидуумов.

Osho обладал глубочайшим пониманием того, каким образом должна быть представлена его работа, и насколько важен “брендинг”. Он добавил свое имя ко всему – от зданий, медитаций и музыки до департаментов и дискотек – на самом деле все, что связано с его работой, было первоначально названо именем “Раджниш”. Уже в 1970-х его имя было зарегистрировано на международном уровне товарным знаком, который защищал его работу, и это имя было зарезервировано для работы его фонда и его медитационных центров, гарантируя тем самым, что его имя и бренд будут известны во всем мире.

Товарные знаки являются “индикаторами источника” – они подтверждают, откуда приходят продукт или услуга. Мы знаем товарные знаки, в основном, в коммерческом и корпоративном контексте, будучи знакомыми с большими марками как Sony, Microsoft, Apple, но законодательство о товарных знаках также предоставляет такую же защиту благотворительным организациям с некоммерческой направленностью, и, как в случае с Osho, с “духовной” или, скорее, “философской” направленностью работы, товара или услуги. Osho часто описывал связь с ним и его работой как “любовную связь”.

Во время своего пребывания в теле Osho создает фонд, ответственный за официальное распространение и публикацию его работ, а также создает бренд и товарный знак, которые делают фонд официальным источником. Публикации, названия для медитационных центров и техники медитаций приходят от фонда и распространяются людьми Osho, которые принимают участие в работе фонда на основе идей Osho об участии, вкладе, медитации и праздновании. В своем обвинении в том, что товарный знак OSHO является “монополизацией”, Деч показал свое полное непонимание закона о товарных знаках, защиты интеллектуальной собственности и прав личности и намеренно искаженно истолковал Osho и его просьбу защитить его имя и работу, и заявил в этих разбирательствах: “Намерения самого Osho не имеют значения”. Торговая марка OSHO доступна бесплатно по лицензии для медитационных центров и организаций Osho, которые разделяют видение Osho и связаны с фондом. Osho абсолютно однозначно заявлял, что, независимо от нашего желания сделать его некой харизматической фигурой Спасителя, он не является “лидером” любого рода, религиозным или иным, и он решительно дистанцировался от всех подобных исторических фигур:

“Я нес тяжелый груз на себе, на своем сердце. Мое здоровье было разрушено по многим причинам; самым главным было то, что я говорил о людях, с которыми я полностью не согласен. И не просто не согласен – я нахожу их по сути психотиками, невротиками, шизофрениками, выступающими против жизни. Все эти прошлые религии были анти-жизненными. Против жизни, против радости, против смеха. Ни одна религия не воспринимала чувство юмора как качество религиозности”.

Практические последствия

В 1989 году Osho выступает с просьбой, чтобы представление его работ во всех аспектах, включая его медитации и медитационные центры, было переименовано в “OSHO”, заменив старый бренд, носящий его предыдущее имя. Osho просит, чтобы все продукты и услуги отныне маркировались “OSHO”.

Заявления многочисленных лидеров медитаций и так называемых Osho-терапевтов, поданные в поддержку признания знака недействительным, были решительно отвергнуты судьями, которые упомянули, что эти заявления, похоже, связаны с их личным доходом. ‘Osho фестиваль’, ‘Osho Празднование’, ‘Osho Тренинг Пульсаций’ и так далее, находятся под правовой защитой закона о товарных знаках: “поскольку [Фонд] работает под именем OSHO, ставит целью популяризацию жизни и видения OSHO, и, соответственно, брендирует всю свою деятельность под этой маркой”.

Тот факт, что Osho передал Фонду работу по защите и публикации своей интеллектуальной собственности, поставив ее под опеку определенной группы людей, был атакован Дечем как “монополизация” – эта характеристика была полностью отвергнута судьями.

Суд окончательно постановил, что товарный знак OSHO не является общественным достоянием и не может быть использован всеми для публикации, продвижения, рекламы или любой медитационной активности, а также учетных записей, групп и мероприятий в социальных сетях, если на это не получено специальное разрешение. Решение суда дает понять, что просто чувство “вдохновения” работами Osho не является достаточным аргументом для использования его товарного знака. “В отличие от слова ‘Будда’ OSHO не является именем, которое стало общественным достоянием”: это объясняет, что в онлайн мире социальных сетей, аккаунтов и сайтов, которые используют товарный знак или имя автора Оsho, а также публикуют или предлагают запрещенные и/или не связанные услуги или продукты под знаком “OSHO”, классифицируются как нарушения действующей торговой марки фонда.

Знак действует более чем в 40 странах. Этим решением Европейский Суд оградил торговую марку “OSHO” от попытки снять защиту с работ Osho – это защита обеспечена законом о товарных знаках, который действует с 1970-х годов.

Osho International Foundation владеет, защищает и активно лицензирует авторские права на работы Osho и название бренда OSHO и делает это с 1985 и 1989 соответственно. Обе охранительные правовые концепции авторского права и товарного знака уже были юридически реализованы в течение жизни Osho и всегда были правовой основой его работы. Любые утверждения о том, что работа и интеллектуальная собственность Osho должны быть свободны от правовой защиты, или заявления о том, что Osho лично хотел, чтобы его работа была незащищенной и свободно доступной для всех, являются глупостью, злонамеренной попыткой подорвать работу Osho. На основе этого решения фонд в настоящее время может принять все необходимые меры для защиты своих прав и представить работу Osho в соответствии с его видением.

La Corte Suprema d’Europa Conferma OSHO Trademark / Lovemark!

Il Tribunale europeo – una branca della Corte di giustizia dell’Unione europea – ha emesso il verdetto finale sul marchio OSHO e ne conferma la proprietà da parte della OSHO International Foundation (OIF)

Oggi è stata resa definitiva una decisione del Tribunale dell’Unione Europea in Lussemburgo, risalente all’11 Ottobre 2017 – questa sentenza notifica la validità della proprietà del marchio OSHO da parte di OSHO International Foundation, Svizzera [caso T670 / 15].

In questo articolo si vuole esaminare da vicino lo scenario di questo caso legale, le sue implicazioni, per dare ai lettori dell’Osho Times il contesto in base al quale Osho ha visto la necessità di proteggere legalmente il suo nome e il suo lavoro e al tempo stesso si vuole anche aiutare a comprendere i motivi che rendono oggi il marchio OSHO assolutamente unico e largamente affermato

La sentenza finale odierna è in realtà la conferma legale di due precedenti delibere dell ’Ufficio dell’Unione Europea per la proprietà intellettuale (EUIPO) del 2014 e del 2015, che hanno accolto in modo favorevole, senza dubbio alcuno, la richiesta di OSHO International Foundation (OIF) di registrare il nome OSHO come marchio di proprietà di OIF, respingendo qualsiasi pretesa per annullarlo intentata in quegli anni. Con la sentenza di oggi, il Tribunale ha confermato in maniera definitiva le precedenti decisioni dell’EUIPO dettagliando e riconoscendo ciascun punto di tali delibere. Chi fosse interessato, trova nell’archivio online dell’OSHO Times Edizione inglese, quanto è stato riferito in precedenza rispetto alla decisione dell’EUIPO.

Il tentativo di invalidare la proprietà e lo stesso marchio OSHO è connesso a un’azione di un piccolo gruppo di persone, portata avanti con l’intento di ottenere il controllo della proprietà intellettuale di Osho. Queste persone erano in precedenza coinvolte direttamente nel lavoro della Fondazione; e includevano – ed erano guidate – da Robert Doetsch, conosciuto anche come Swami Ramateertha, figura di controllo di un OSHO Meditation Center locale, con sede a Colonia, in Germania. Doetsch, che è anche discepolo di UG Krishnamurti, ha dunque utilizzato un centro di meditazione di Osho per lanciare un attacco legale contro il lavoro di Osho.

Inoltre, Doetsch era ed è coinvolto in altri attacchi simili, tra cui un tentativo del 2014 di prendere il controllo di OIF, la Fondazione svizzera. Ma in quel caso, con una risposta pungente, formulata in modo insolito, il governo svizzero ha respinto tutte le accuse avanzate contro i direttori di OIF e ha evidenziato come Doetsch avesse sviato le autorità svizzere con accuse false e tendenziose. Inoltre, le autorità svizzere hanno scoperto che aveva intenzionalmente taciuto il fatto che dal 2000 lui e la sua cordata avevano tentato di avviare un’azione legale contro OIF in vari Paesi, con l’obiettivo di “annullare” i marchi registrati e le proprietà dei diritti d’autore di OIF. Di fatto, Doetsch e il suo gruppo avevano agito con l’intento di appropriarsi di OIF, una Fondazione dalla quale Osho aveva personalmente chiesto a Doetsch di dimettersi trent’anni prima, nel 1986, dopo essere stato inizialmente nominato nel suo consiglio d’amministrazione da Sheela Silverman.

Nello stesso modo in cui ha cercato di fuorviare le autorità svizzere, Doetsch ha intenzionalmente fuorviato l’Ufficio Marchi Europeo, fingendo di essere un’entità indipendente e nascondendo il suo precedente stretto rapporto con la Fondazione. Su questo punto i giudici hanno evidenziato che “Il richiedente [Osho Lotus Commune e.V e Robert Doetsch] ha tentato di nascondere la sua associazione di lunga data con l’OIF”.

Nell’ambito di questi casi legali, Doetsch e il suo gruppo, agendo come politicanti, hanno pubblicato per anni “notizie false”, diffondendo intenzionalmente disinformazione sui marchi e il loro uso nel contesto del lavoro di Osho, ingannando i lettori al fine di danneggiare l’integrità e la reputazione di OIF, una Fondazione creata da Osho perché il suo lavoro fosse portato avanti. Sia il governo svizzero sia l’ufficio marchi dell’UE hanno denunciato queste circostanze come “maligne”, “false”, “deliberatamente tese a confondere” e “infondate”. Tuttavia, malgrado queste indubitabili sentenze, e le connesse decisioni di questi organismi governativi, Doetsch e il suo gruppo hanno continuato a causare divisioni tra le persone coinvolte nel lavoro di Osho. Ramateertha, in particolare, ha ingannato persone e Centri Osho con falsi dettagli sui marchi OSHO, facendo opera di disinformazione finanziaria e quant’altro nel tentativo di dipingere la Fondazione di Osho come fondamentalmente criminale, commerciale e manipolante.

Dopo aver dato istruzioni affinché il suo intero lavoro sia ora conosciuto e presentato come “OSHO”, nel gennaio 1990 Osho esamina il re-branding del suo lavoro – nelle immagini le presentazioni del programma della OSHO Multiversity.

Cos’è il marchio OSHO – e che cosa non è?

“OSHO” nel giro di pochi anni si è trasformato in un “Lovemark”, una di quelle situazioni davvero uniche in cui un brand e un marchio registrato sono molto più di una fonte commerciale, ma sviluppano aspetti aggiuntivi tra cui una connessione basata sull’associazione emotiva, il rispetto e l’amore.

Le persone entrano in contatto con OSHO a livelli diversi, attraverso la pubblicazione delle opere di Osho e altre attività di OIF, tra cui: proposte esperienziali di meditazione, musica dal mondo di Osho, video su internet, audiolibri, una visita all’Osho International Meditation Resort o a un OSHO Meditation Center… e molto altro ancora. In ogni caso, ciò che verrà sperimentato è qualcosa di unico: tante unicità quante sono le persone.

Osho ha sempre avuto un’incredibile comprensione di come presentare il suo lavoro, e dell’importanza di “marcare” il suo lavoro in modo dettagliato, aggiungendo il suo nome a tutto: edifici, meditazioni, musica, dipartimenti, discoteche – in realtà qualsiasi cosa connessa al suo lavoro aveva in origine il marchio “Rajneesh”. Infatti, anche negli anni ’70/80 il suo nome era un marchio registrato a livello internazionale che proteggeva il suo lavoro e lo rendeva un’esclusiva della sua Fondazione e dei suoi Centri di meditazione, assicurando al tempo stesso che il suo nome e il suo marchio fossero conosciuti in tutto il mondo.

I marchi sono di fatto “indicatori di origine” – confermano da dove proviene un prodotto o un servizio. Conosciamo i marchi perlopiù in un contesto commerciale e aziendale, avendo familiarità con grandi Brand come SONY® , Microsoft® e Apple®, ma la legge sui marchi garantisce anche la stessa protezione a enti di beneficenza con un focus non commerciale e, come nel caso di Osho, con un aspetto e un focus “spirituale” o più “filosofico” nei loro servizi, nel loro lavoro e nei loro “prodotti”. Osho descrive spesso la connessione con lui e il suo lavoro come una “storia d’amore”. E nel tempo da lui vissuto nel corpo, Osho crea una Fondazione responsabile per la distribuzione formale e per le pubblicazioni del suo lavoro, responsabile anche del brand e del marchio registrato, indicando la Fondazione come fonte formale.

Le pubblicazioni, i nomi dei Centri di meditazione e le meditazioni hanno tutti origine dalla Fondazione e sono realtà condivise dalle persone coinvolte nel lavoro di Osho che si associano in base al suggerimento dato da Osho di “partecipare, contribuire, meditare e celebrare”. Oggi il marchio OSHO, da tempo un “marchio d’amore” per molti, rappresenta di fatto un’ampia gamma di prodotti digitali, libri, tecniche e servizi di meditazione e un intero programma di stile di vita che integra l’insieme degli aspetti che caratterizzano la sua visione sotto un “marchio d’amore”.

Nella sua accusa iniziale, secondo cui il marchio OSHO è “una monopolizzazione”, Doetsch ha dimostrato un totale fraintendimento della realtà di quei marchi, della protezione della proprietà intellettuale e dei diritti connessi alla personalità; e ha intenzionalmente frainteso Osho e la sua richiesta di proteggere il suo nome e il suo lavoro, arrivando a dichiarare in sede processuale che: “Le intenzioni dello stesso Osho sono irrilevanti.”

Il tribunale ha respinto tutte le sue argomentazioni e ha confermato ciò che Osho ha sempre voluto; ovvero che il suo lavoro venga reso disponibile, sotto il marchio OSHO, che può essere condiviso sotto il controllo di qualità di OIF da parte di persone di cui Osho si fidava e venga impedito che qualsiasi Tizio, Caio o Sempronio possa operare sotto l’ombrello di OSHO e fingere di far parte di un ipotetico “lignaggio di Osho”, offrendo le proprie idee personali o propagare versioni distorte della sua visione.

Il marchio OSHO è disponibile gratuitamente su licenza per i Centri di meditazione e le organizzazioni di Osho che condividono la visione di Osho in connessione con OIF. Il marchio non è disponibile per le persone che cercano di gestire le loro attività personali non autorizzate per il proprio arricchimento, né per le attività, come nel caso di Doetsch e del suo gruppo, esplicitamente contrari alla Fondazione di Osho.

È bene sottolineare un aspetto molto importante in questo caso: Doetsch ha cercato di falsare Osho, mettendolo nella stessa categoria di Gesù, del Buddha e altre figure religiose che sono oggi sfruttate da religioni istituzionali.

Il tribunale ha respinto qualsiasi tipo di confronto e qualsiasi argomento sollevato in questa prospettiva. Osho è un individuo che appartiene all’epoca contemporanea, gode della protezione legale delle sue opere, dei suoi diritti d’autore e del suo nome – anche se alcune persone non hanno compreso lo sforzo fatto da Osho durante tutta la sua vita pubblica di combattere queste figure religiose e le religioni che hanno originato.

Osho ha ribadito con chiarezza e incessantemente un fatto fondamentale: non importa quanto potremmo volere che sia una figura tipica di salvatore carismatico, lui non è un “leader” di alcun genere, religioso o altro, e in particolare ha preso con forte enfasi le distanze da tutte queste figure storiche, esplicitando che

“Ho portato un peso enorme su di me, sul mio cuore. La mia salute è stata distrutta per molte ragioni: la più importante è che ho parlato di persone con cui non sono affatto d’accordo. Non sono assolutamente d’accordo – non solo non sono d’accordo, ma li trovo fondamentalmente psicotici, nevrotici, schizofrenici, contrari alla vita. Tutte queste religioni nate nel passato sono anti-vita. Nessuna è per la vita, nessuna è per vivere, nessuna è per ridere. Nessuna religione ha accettato il senso dell’umorismo come qualità di religiosità”. ~Osho

Implicazioni pratiche

Nel 1989, Osho chiede che la presentazione del suo lavoro nel suo complesso, in tutti i suoi aspetti, comprese le sue meditazioni e i centri di meditazione, abbia il nuovo marchio “OSHO”, sostituendo il marchio di vecchia data legato al suo nome precedente. Osho richiede che tutti i prodotti e i servizi siano targati “OSHO”.

Le dichiarazioni di numerosi insegnanti di meditazione e dei cosiddetti Osho Therapist depositate a sostegno dell’invalidazione del marchio sono state fortemente respinte dai giudici che hanno deliberato che queste affermazioni sembravano dipendere dal loro reddito personale. Dopo la sentenza, diverse persone si sono scusate pubblicamente per essere state coinvolte e aver sostenuto questo attacco al lavoro di Osho e alla Fondazione. Aneesha, Kovida

Il tribunale ha riconosciuto e confermato che attività, servizi e prodotti con combinazioni di parole come ‘Meditazioni di Osho’, ‘Osho Meditation Centers ‘ , ‘OSHO TIMES’, ‘OSHO’ come autore, ‘Musica dal mondo di Osho’, ‘Osho Dance Meditation Training’; ‘Osho Full Moon Camp’; ‘Osho Management Training’; ‘Osho Festival’, ‘Osho Celebrations’, ‘Osho Pulsation Training’e così via, sono coperti dalla protezione legale data dai marchi, “dal momento che la [Fondazione] opera sotto il nome di OSHO, ha esplicitamente lo scopo di promuovere i lavori e le visioni di OSHO e di conseguenza denomini tutte le sue attività includendole sotto questo marchio”.

Il fatto che Osho abbia conferito il lavoro di proteggere e pubblicare questa proprietà intellettuale alla Fondazione, mettendola sotto la tutela di un gruppo specifico di persone, è stato attaccato da Doetsch come “monopolizzazione” – una accusa fermamente respinta dai giudici.

Pertanto, è stato definitivamente deciso dal tribunale che il marchio OSHO non è di dominio pubblico e non può essere utilizzato da chiunque per la pubblicazione, la promozione, la pubblicità o qualsiasi attività di meditazione, account di social media, gruppi o attività, a meno che non sia autorizzato.

La sentenza chiarisce che il semplice sentirsi “ispirati” da Osho non è un argomento in alcun modo accettabile per l’utilizzo del marchio. “Diversamente da ‘Buddha’, OSHO non è un nome che appartiene saldamente al pubblico dominio”, il che chiarisce che nel mondo dei social media online, account e siti web che utilizzano il nome o il nome dell’autore, Osho, e pubblicano o offrono servizi o prodotti che violano e/o non sono collegati al marchio “OSHO”, agiscono a tutti gli effetti in violazione del marchio di proprietà della Fondazione.

Il marchio è valido in oltre 40 paesi. Con questa decisione, la Corte Europea ha difeso il marchio “OSHO” dal tentativo di rimuovere la protezione del lavoro di Osho – una protezione prevista dalla legge sui Brand che è in vigore dagli anni 70.

La Osho International Foundation detiene, protegge e concede in licenza attiva i diritti d’autore delle opere di Osho e il marchio OSHO e lo ha fatto dal 1985 e dal 1989 rispettivamente. Entrambi i concetti legali protettivi di copyright e marchio erano già effettivi legalmente durante la vita di Osho e sono sempre stati la struttura legale a fondamento del suo lavoro. El Tribunal Superior Europeo Confirma la marca registrada OSHO / Lovemark!

El Tribunal General de la Unión Europea – una sección del Tribunal de Justicia de la Unión Europea – toma una decisión definitiva sobre la marca registrada OSHO y confirma que su propiedad pertenece a Osho International Foundation (OIF)

La decisión del 11 de octubre de 2017 del Tribunal General de la Unión Europea en Luxemburgo, es ahora definitiva y confirma la validez de OSHO como marca y su propiedad por parte de Osho International Foundation, Suiza [caso T670 / 15].

En este artículo analizamos de cerca el trasfondo de este caso legal y sus implicaciones, y brindaremos a los lectores de Osho Times un trasfondo sobre por qué Osho vió la necesidad de proteger legalmente su nombre y su trabajo, y el éxito y singularidad de la marca registrada OSHO.

El fallo judicial definitivo de este caso constituye, de hecho, la confirmación legal de dos fallos judiciales anteriores de la Oficina de Propiedad Intelectual de la Unión Europea (EUIPO)  en 2014 y 2015, que tomaron dos decisiones muy claras a favor de la reclamación de la marca por parte de OIF, rechazando cualquier intento de cancelarla. El Tribunal General confirmó en esta sentencia definitiva las decisiones anteriores de la EUIPO sobre cada uno de los puntos. El OSHO Times ha informado anteriormente sobre la decisión de EUIPO.

El intento de invalidar la marca registrada de OSHO ha sido parte de un ataque concertado por un pequeño grupo de personas, intentando obtener el control de la propiedad intelectual de Osho. Estas personas estuvieron previamente involucradas en el trabajo de la fundación, incluyendo y encabezados por Robert Doetsch, también conocido como Swami Ramateertha, la figura controladora de un Centro local de Meditación Osho en Colonia, Alemania. Doetsch, que también es discípulo de UG Krishnamurti, usó un Centro de Meditación Osho para lanzar un ataque legal contra el trabajo de Osho.

Doetsch estuvo y está involucrado en otros ataques similares, incluyendo un intento en el año 2014 de tomar el control de la fundación suiza.

En una respuesta redactada en una forma inusualmente aguda, el gobierno suizo rechazó todas las afirmaciones hechas contra los directores de la Fundación y confirmó que Doetsch había engañado a las autoridades suizas con acusaciones falsas y maliciosas. Además, el gobierno suizo consideró que había ocultado intencionalmente el hecho de que desde el año 2000, él y otras partes estrechamente relacionadas habían intentado emprender acciones legales contra Osho International Foundation (OIF) en varios países, con el objetivo de “derribar” las marcas registradas y derechos de autor de OIF. Doetsch y su grupo habían tomado medidas para secuestrar la fundación, la misma de la que Osho había pedido personalmente a Doetsch que renunciara treinta años antes, en 1986, después de que Sheela Silverman lo nombrara inicialmente miembro del consejo.

Como en el caso en la acción suiza, Doetsch intencionalmente engañó a la Oficina Europea de Marcas, pretendiendo ser una parte independiente, ocultando su estrecha relación previa con la fundación. Sobre este punto, los jueces declararon: “El solicitante [Osho Lotus Commune e.V y Robert Doetsch] ha intentado ocultar su antigua asociación con OIF”.

En el contexto de estos casos legales, Doetsch y su grupo, actuando como políticos, publicaron durante años “noticias falsas”, diseminando intencionalmente información errónea sobre marcas y su uso en el contexto del trabajo de Osho, engañando al público para dañar la integridad y reputación de la fundación creada por Osho para continuar su trabajo. Tanto el gobierno suizo como la Oficina de marcas de la UE expusieron estos detalles como “maliciosos”, “falsos”, “deliberadamente confusos” y “sin fundamento”. A pesar de estas decisiones claras de estos organismos gubernamentales, Doetsch y su grupo continuaron su esfuerzo para causar divisiones entre las personas involucradas en el trabajo de Osho.

Ramateertha engañó a las personas y a los centros de Osho con detalles falsos sobre las marcas registradas de OSHO, desinformación financiera y demás, básicamente tratando de describir la Fundación Osho básicamente como criminal, comercial y controladora.

Después de pedir que todo su trabajo ahora se conociese y presentara bajo “OSHO”, en enero de 1990, Osho revisa el cambio de marca de su trabajo: las presentaciones del programa de la OSHO Multiversity.

¿Qué función tiene la marca comercial OSHO —y cuál no?

“OSHO” ahora se ha convertido en una “marca de amor”, una de estas situaciones únicas donde una marca y marca comercial es mucho más que una fuente comercial, pero que desarrolla aspectos adicionales que incluyen una conexión basada en la asociación emocional, el espeto y el amor.

Osho tiene una increíble comprensión de cómo presentar su trabajo, y de la importancia de “fidelizar” su trabajo al agregar su nombre a todo, desde edificios, meditaciones, música, departamentos, discotecas; de hecho, todo lo relacionado con su trabajo fue originalmente fidelizado con el nombre “Rajneesh.” Incluso en la década de 1970 su nombre era una marca registrada internacionalmente que protegía su trabajo y reservaba este nombre para su fundación y sus centros de meditación, asegurando que su nombre y marca fueran conocidos en todo el mundo.

Las marcas comerciales son “indicadores de origen”: confirman de dónde proviene un producto o servicio. Conocemos marcas registradas principalmente en un contexto comercial y corporativo, estamos familiarizados con grandes marcas como SONY®, Microsoft®, y Apple®, pero la ley de marcas también otorga la misma protección a entidades caritativas con un enfoque no comercial y, como en el caso de Osho un aspecto “espiritual” o más “filosófico” con un enfoque de sus servicios, trabajo y productos. Osho a menudo describe la conexión con él y su trabajo como una “historia de amor”.

Durante su tiempo en el cuerpo, Osho crea una fundación responsable de la distribución formal y las publicaciones de su trabajo y marca y la marca comercial que indica a la Fundación como el origen formal. Las publicaciones, los nombres de los centros de meditación y las meditaciones provienen de la fundación y son compartidas por las personas de Osho que se involucran y se asocian a ellos en base a las sugerencias de participación, contribución, meditación y celebración de Osho. En su acusación de que la marca registrada de OSHO es “monopolización”, Doetsch mostró una total incomprensión de las marcas registradas, de la protección de la propiedad intelectual y los derechos de la personalidad, y malinterpretó intencionalmente a Osho y su solicitud de proteger su nombre y trabajo y declaró en este procedimiento: “Las intenciones del propio Osho son irrelevantes “. El tribunal rechazó todos esos argumentos y confirmó lo que Osho siempre ha deseado: que su trabajo esté disponible, bajo la marca OSHO, que puede ser diseminado bajo el control de calidad de la Fundación por personas de Osho de confianza y para evitar que cada “Tom Dick y Harry” pueda operar bajo el paraguas de OSHO y pretender estar en algún “linaje de Osho”, ofreciendo sus propias ideas o versiones distorsionadas de su visión.

La marca registrada de OSHO está disponible de forma gratuita bajo licencia para los centros de meditación y entidades de Osho que comparten la visión de Osho en conexión con la fundación.

La marca no está disponible para las personas que intentan ejecutar sus negocios personales no autorizados para su enriquecimiento, ni para las actividades, como en el caso de Doetsch y su grupo, explícitamente en contra de la fundación de Osho.

Un aspecto muy importante en este caso fue Doetsch tratando de tergiversar a Osho al colocarlo en la misma categoría que Jesús y Buda y otras figuras principales que son hoy explotadas por las religiones establecidas. El tribunal rechazó tal comparación y cualquier argumento en esta dirección. Osho es un individuo de los tiempos modernos que disfruta de protección legal de su trabajo, sus derechos de autor y su nombre, incluso si algunas personas no entienden el punto que Osho hace a lo largo de su vida pública, peleando con estas figuras religiosas y las religiones que provocaron.

Osho ha sido infinitamente claro que, no importa cuánto podamos querer que sea una figura salvadora carismática, él no es un “líder” de ningún tipo, religioso o de otro tipo, y en particular se distanció enfáticamente de todas esas figuras históricas:

Implicaciones prácticas

En 1989, Osho solicita que la presentación de su trabajo completo en todos los aspectos, incluidas sus meditaciones y centros de meditación, se cambie de marca a “OSHO”, reemplazando a la marca utilizada durante muchos años con su nombre anterior. Osho solicita que todos los productos y servicios estén marcados con “OSHO”.

Las declaraciones de numerosos profesores de meditación y los llamados terapeutas Osho presentados en apoyo de la invalidación de la marca fueron fuertemente rechazados por los jueces que mencionaron que estas declaraciones parecían estar vinculadas a sus ingresos personales. El tribunal reconoció y confirmó que las actividades, servicios y productos en combinaciones de palabras como ‘Meditaciones Osho’, ‘Centros de meditación Osho’, ‘OSHO TIMES’, ‘OSHO’ como autor ‘,’ Música del Mundo de Osho ‘,’ Osho Dance Meditation Training ‘; ‘Osho Full Moon Camp’; ‘Formación de gestión de Osho’; ‘Osho Festival’, ‘Osho Celebrations’, ‘Osho Pulsation Training’ y otros, están cubiertos por la protección legal de marcas registradas, “ya que [Foundation] opera bajo el nombre de OSHO, explícitamente apunta a promover el trabajo de la vida y la visione de OSHO y por lo tanto, fideliza todas sus actividades bajo esta marca “.

Ahora el tribunal decidió de forma definitiva que la marca registrada de OSHO no es de dominio público y no puede ser utilizada por todos para la publicación, promoción, publicidad o cualquier actividad de meditación, cuentas de redes sociales, grupos o actividades, a menos que obtengan el permiso. El juicio deja en claro que sentirse “inspirado” por Osho no es un argumento aceptable para utilizar la marca de ninguna manera. “A diferencia de ‘Buda’, OSHO no es un nombre que pertenece firmemente al dominio público”, lo cual aclara que en el mundo de las redes sociales en línea, cuentas y sitios web que usan la marca o el nombre del autor, Osho, y publica u ofrece infracciones y / o servicios o productos no relacionados bajo la marca, “OSHO” son infracciones de la marca válida de la fundación.

La marca es válida en más de 40 países. Con esta decisión, el Tribunal Europeo ha defendido la marca “OSHO” de un intento de eliminar la protección del trabajo de Osho; protegida por ley de marcas y que ha estado vigente desde la década de 1970.

Osho International Foundation es propietaria, protege y licencia activamente los derechos de autor de las obras de Osho y la marca OSHO, y lo ha hecho desde 1985 y 1989, respectivamente.
